CommuniCare hired ETR Development Consulting, LLC to assist them with the development of approximately four (4) acres of land in the City of Kyle near the new Seton Medical Center – Hays.  The City requested that the site be downzoned from an industrial classification to a more appropriate retail/services classification.  After approval of the rezoning, ETR assisted in securing the approval of a final plat for the site.  Through the platting process, the City required the dedication of additional right-of-way (ROW) along the frontage of the site as well as payment of fees-in-lieu of construction of improvements to the adjacent roadway.

CommuniCare’s property in Kyle was a unique site with a range of 150 to 300 feet in depth but almost 800 feet in frontage.  The dedication of additional ROW along the frontage would have restricted development of the site.  The amount of frontage resulted in over $300,000 due in fee-in-lieu of construction payments.  Furthermore, Hays County was in the process of design, acquisition and reconstruction of the adjacent roadway and had already acquired all necessary ROW from the property on the opposite side of the road.  ETR submitted for and successfully achieved City Council approval of two (2) variances to the platting requirements saving CommuniCare significant costs which could have derailed a much needed project for northeast Hays County.
